Privacy Policy

By registering and using Deskare, you will provide us with, and we will collect, information about you, including information used to identify you. This is what we call your "personal data". This is data that identifies you directly, such as your last name, first name or image, or indirectly, such as your password, phone number or browsing or session data. It is important that you know how this Data is collected, what we do with it and for how long, so that you can be fully informed of your rights. That is why we have prepared this document, which we have tried to make as clear and simple as possible. If, despite our efforts, you have any questions, please do not hesitate to contact us using the contact information in Section 10.

This Privacy Policy is an integral part of our Deskare Terms and Conditions of Use. It should therefore be read in conjunction with the latter.

WHO IS RESPONSIBLE FOR PROCESSING YOUR PERSONAL DATA?


This is Deskare SAS. We are a French company and our headquarters are located in Versailles (France). Deskare SAS publishes the Deskare application, a web application that allows you to meet your teammates and see analyses on office attendance and workspace occupancy.

WHAT DATA DO WE COLLECT?


In order to operate Deskare, we collect information (i) that you provide to us directly, as well as (ii) data that we collect automatically.

(i) Data you provide directly to us

Registration data: in order to use Deskare, you must create an account and provide us with the following personal data:

- Your full name (visible to other users).

- Your preferred work location: you will be able to choose from a list of offices defined by your company, the one where you work the most. This information allows us to calculate the occupancy data used by your company to understand, among other things, how offices are used.

- Your time zone and language: this information allows us to tailor your experience on Deskare to your preferences.

- The password that will allow you to log in to your account. Naturally, this information is not visible to other users, and you should never share it with other users. Your password is personal and secret. It must contain at least 8 alphanumeric characters. It is necessary to ensure the security of your account. All this information is required to create your profile and register on Deskare.

You may, if you wish, complete other sections of your profile (profile picture). This information is optional.

- Data about your interaction with Deskare: If you report a problem, request assistance or exercise your rights, we will process the information you provide. In addition, if there is reasonable doubt about your age, we may ask you to verify your age and request the following information;

- Data about your activity on Deskare: when you use Deskare, we may collect and process information such as when you registered, when you last logged in, your interactions with our app pages, to understand and improve the user experience on the Deskare app.

- Content data: the profile picture you choose to upload to your profile will be visible to all users. Be careful what you share with others and remember that all users can record the content you share and there is nothing we can do to prevent this.

- Device and Hardware Data: we collect information from and about the devices and hardware you use to access Deskare, such as IP address, device type, advertising ID (e.g., Google's AAID and Apple's IDFA, both of which are randomly generated numbers that you can reset by going to your device's settings), bugs, app version and language, operating system, etc.

- Cameras and photos: in order to send and upload photos from your camera, you must give us permission to access them.

WHAT ARE THE LEGAL REASONS WHY WE COLLECT DATA?


When we collect and process your personal data, we may do so for the following reasons:

- To allow you to access Deskare and use the services we provide: this effectively means that you are fulfilling the contract we have with you, which is our terms and conditions of use, which include this privacy policy. For example, when you use Deskare, we use your data to operate your account or make your profile available.

- In Deskare's legitimate interest: we may use your data if we have a legitimate reason to do so. For example, we process data for administrative purposes, to guard against fraudulent and illegal behavior (e.g. false age), and to ensure that the application remains secure.

- To fulfill a legal obligation: we are required, for example, to retain data identifying new content and to pass it on to the authorities if they request it.

- With your or your legal guardian's consent: if we process data with your consent, you can withdraw that consent at any time by going to "Settings".

HOW DO WE USE THE DATA WE COLLECT?


We collect, use and store your Personal Data to process your requests, manage our relationship and your use of Deskare, optimize our services and tools to create and maintain a secure environment, and fulfill our legal obligations, as explained below.

Security and fulfilment of legal and contractual obligations

- To respond to requests from administrative and judicial authorities, law enforcement officials and court officers, and to comply with court orders;

- Identify and prevent fraudulent activities and threats to the security of Deskare in accordance with the law;

- Analyze reports of users who have violated our terms of use and/or applicable regulations;

- Improve the safety and security of our services;

- To use the information collected via cookies or other technology to improve our services and your user experience;

- To enforce our Terms of Use and this Privacy Policy;

- To counter fraud (e.g. age-related), confirm your identity and fight against illegal activities.

HOW LONG DO WE KEEP YOUR DATA?


You can delete your account at any time by clicking on the corresponding button in your "Settings". When you delete your account, you will immediately stop providing Deskare with your current and future contact information and your profile will no longer be accessible. We will only retain your Personal Data for the period of time necessary to fulfill the purposes for which we process your data, unless we are permitted or required by law to retain it for a longer period of time. As a general rule, we will delete your Data as soon as you delete your account, unless:

- We are required to retain it to demonstrate our compliance with applicable law (for example, records of consent to our terms of use, privacy policy and similar consents are retained for five years);

- We are required, because of an unresolved issue, claim or dispute, to retain the relevant information until the matter is resolved; or

- If data must be retained as part of our legitimate business interests, for example, to prevent fraud and improve user safety and security. For example, we may be required to retain data to prevent a user who has been banned from opening a new account due to unsafe conduct or a security incident.

WHO HAS ACCESS TO THE DATA WE COLLECT?


The data we collect is intended only for internal use by Deskare and our partners and service providers. Only certain authorized Deskare managers and employees will process your personal data for the above purposes, and they are only authorized to access data that is strictly necessary for the performance of their work. Deskare may also enter into an agreement with authenticated and trusted service providers and partners who may access and/or process users' personal data and who ensure that such data will remain secure and confidential in accordance with this Policy. These service providers and partners help us to operate and improve Deskare, including data hosting, research, analysis and statistics, application usage and/or operation, targeted advertising, combating user age fraud, and support requested by users. Finally, the data we process may be transmitted to the police and to judicial and administrative authorities in order to enable us to fulfill our legal obligations.

WILL YOUR DATA BE TRANSFERRED OUTSIDE THE EUROPEAN UNION?


The Personal Data of the Deskare Users are kept on servers located in the European Union. In the event that transfers are made to countries outside the European Union, they are carried out under the guarantee of standard contractual clauses as published by the European Commission.

HOW IS YOUR DATA PROTECTED?


Deskare ensures that your data is treated securely and confidentially, including in the case where certain operations are carried out by partners. Consequently, appropriate technical and organizational measures are implemented to prevent the loss, misuse, alteration and deletion of your Personal Data. Nevertheless, there is no such thing as "zero risk" on the Internet and we cannot guarantee 100% security of your Personal Data. That is why it is important to inform us immediately if you believe that you have been the victim of an attack on your Personal Information, by writing to us here.

YOUR RIGHTS


You have the right to access your Personal Data and to request that it be corrected, completed or updated. You can also request that your Data be deleted (or you can delete your account in the "Settings" section of the application), refuse the processing of your Data, or request that it be limited under the terms of applicable law. You may request to exercise your right to data portability, i.e., your right to receive your Personal Data in a frequently used structured format and your right to send such data to another processor. As stated in Section 3 above, your data is processed with your consent and you can withdraw your consent at any time by going to "Settings". You also have the right to give instructions on how your personal data should be used after your death. In order to exercise your rights, you will be asked to produce proof of your identity of any kind. You may submit your request by sending a letter or e-mail to hello@deskare.io or on Deskare in the "Support" section. We will do our best to comply with your requests, but please remember that this right is not unlimited and must be exercised in accordance with the conditions of the applicable legislation. Any request to exercise your rights must be reasonable. If necessary, we will explain why we are unable to satisfy your request. For all other complaints, please contact the competent national data protection authority.

Updates to our privacy policy

It may be necessary to update this Privacy Policy, including to comply with applicable regulations, or if there is a change in the way we use your Personal Data. You will be notified in advance of any changes or updates by any appropriate means, including messages posted on the Deskare app, or by email. These modifications may require your confirmation in certain cases. In any event, your continued use of Deskare implies your full acceptance of the changes made to this Privacy Policy.
