Privacy Policy

By registering and using Deskare, you will provide us with, and we will collect, information about you, including information used to identify you. This is what we call your "personal data". This is data that allows you to identify yourself directly, such as your last name, first name or image, or indirectly, such as your password, telephone number or browsing or session data. It is important that you know how this Data is collected, what we do with it and for how long, so that you can be fully informed of your rights. That's why we've prepared this document, which we've tried to make as clear and simple as possible. If, despite our efforts, you would like to ask us any questions, please do not hesitate to contact us using the contact details in section 10.

This privacy policy is an integral part of our Deskare Terms of Service. It should therefore be read at the same time as the latter.

WHO IS RESPONSIBLE FOR PROCESSING YOUR PERSONAL DATA?


It's Deskare SAS. We are a French company and our head office is located in Versailles (France). Deskare SAS publishes the Deskare application, a web application that allows you to meet your teammates and see analyses on office attendance and workspace occupancy.

WHAT DATA DO WE COLLECT?


In order to operate Deskare, we collect information (i) that you provide to us directly, as well as (ii) data that we collect automatically.

(i) Data you provide to us directly

Registration data: in order to use Deskare, you must create an account and provide us with the following personal data:

- Your full name (visible to other users).

- Your preferred place of work: you can choose from a list of offices defined by your company, the one where you work the most. This information allows us to calculate the occupancy data used by your company to understand, among other things, how the offices are used.

- Your time zone and language: this information allows us to adapt your experience on Deskare to your preferences.

- The password that will allow you to connect to your account. Naturally, this data is not visible to other users, and you should never share it with other users. Your password is personal and secret. It must contain at least 8 alphanumeric characters. It is necessary to ensure the security of your account. All this information is required to allow you to create your profile and register on Deskare.

You can, if you wish, complete other sections of your profile (profile photo). This information is optional.

- Data concerning your interaction with Deskare: if you report a problem to us, ask for help or exercise your rights, we will process the information you provide to us. In addition, in the event of reasonable doubt as to your age, we may ask you to verify your age and ask you for the following information;

- Data concerning your activity on Deskare: when you use Deskare, we may collect and process information such as the date of your registration, the date of your last connection, your interactions with the pages of our application, in order to understand and improve the user experience on the Deskare application.

- Content-related data: the profile photo that you decide to upload to your profile will be visible to all users. Be careful what you share with others and remember that all users can save the content you share and that we cannot do anything to prevent this.

- Data concerning devices and hardware: we collect information from and about the devices and hardware you use to access Deskare, such as IP address, device type, advertising identifier (e.g. Google's AAID and Apple's IDFA, both of which are randomly generated numbers that you can reset by going to your device's settings), bugs, application version and language, operating system, etc.

- Camera and photos: to be able to send and upload photos from your device, you must give us permission to access it.

WHAT ARE THE LEGAL REASONS FOR COLLECTING DATA?


When we collect and process your personal data, we may do so for the following reasons:

- To allow you to access Deskare and use the services we provide: this effectively means that you are fulfilling the contract we have with you, which corresponds to our general terms and conditions of use, which include this privacy policy. For example, when you use Deskare, we use your data to operate your account or make your profile accessible.

- In Deskare's legitimate interest: we may use your data if we have a legitimate reason to do so. For example, we process data for administrative purposes, to protect ourselves against fraudulent and illegal behaviour (e.g. false age), and to ensure that the application remains secure.

- To fulfil a legal obligation: for example, we are required to keep data identifying new content and to pass it on to the authorities if they ask us to.

- With your consent or that of your legal guardian: if we process data with your consent, you can withdraw this consent at any time by going to "Settings".

HOW DO WE USE THE DATA WE COLLECT?


We collect, use and store your Personal Data in order to process your requests, manage our relationship and your use of Deskare, optimise our services and tools in order to create and maintain a secure environment, and fulfil our legal obligations, as explained below.

Managing our relationship and access to Deskare
- To create and manage your user account (including access to Deskare services and help)

- send information messages concerning Deskare services and your interactions with other users (notifications).

Security and execution of legal and contractual obligations

- To respond to requests from administrative and judicial authorities, law enforcement officers and legal auxiliaries, and to comply with court decisions;

- Identify and prevent fraudulent activities and threats to the security of Deskare in application and in accordance with the law;

- Analyse reports concerning users who have violated our terms of use and/or the regulations in force;

- Improve the safety and security of our services;

- To use the information collected via cookies or any other technology to improve our services and your user experience;

- To enforce our general terms and conditions of use and this privacy policy;

- To counter fraud (for example related to age), confirm your identity and combat illegal activities.

HOW LONG DO WE KEEP YOUR DATA?


You can delete your account at any time by clicking on the corresponding button in your "Settings". When you delete your account, you will immediately stop communicating your current and future details to Deskare and your profile will no longer be accessible. We will only keep your Personal Data for the period of time necessary to achieve the purposes for which we process your data, unless we are authorised or required by law to keep it for a longer period of time. As a general rule, we will delete your Data as soon as you have deleted your account, unless:

- We are required to keep them to prove that we comply with the legislation in force (for example, records of consent to our terms of use, our privacy policy and other similar consents are kept for five years);

- We are required, due to an unresolved problem, claim or dispute, to retain the relevant information until the matter is resolved; or

- If the data must be kept as part of our legitimate business interests, for example to prevent fraud and improve user safety and security. For example, we may be required to keep data in order to prevent a user who has been banned from opening a new account due to their dangerous conduct or a security incident.

WHO HAS ACCESS TO THE DATA WE COLLECT?


The data we collect is intended solely for internal use by Deskare and our partners and service providers. Only certain authorised Deskare managers and employees will process your personal data for the aforementioned purposes, and they are only authorised to access data that is strictly necessary for the performance of their work. Deskare may also enter into an agreement with authenticated and reliable service providers and partners who may access and/or process users' personal data and who guarantee that such data will remain secure and confidential in accordance with this Policy. These providers and partners help us to operate and improve Deskare, in particular with regard to data hosting, studies, analyses and statistics, the use and/or operation of the application, targeted advertising, combating fraud linked to the user's age and assistance required by users. Finally, the data we process may be transmitted to the police and to the judicial and administrative authorities in order to enable us to fulfil our legal obligations.

WILL YOUR DATA BE TRANSFERRED OUTSIDE THE EUROPEAN UNION?


The Personal Data of Deskare Users is stored on servers located in the European Union. In the event that transfers are made to countries that are not members of the European Union, they are carried out under the guarantee of standard contractual clauses as published by the European Commission.

HOW IS YOUR DATA PROTECTED?


Deskare ensures that your data is processed securely and confidentially, including in cases where certain operations are carried out by partners. As a result, appropriate technical and organisational measures are implemented to prevent the loss, misuse, alteration and deletion of your Personal Data. Nevertheless, "zero risk" does not exist on the internet and we cannot guarantee 100% the security of your Personal Data. That is why it is important to inform us immediately if you think you have been the victim of an attack on your Personal Data, by writing to us here.

YOUR RIGHTS


You have the right to access your Personal Data and to request that it be corrected, completed or updated. You may also request that your Data be deleted (or you can delete your account in the "Settings" section of the application), refuse the processing of your Data, or request that it be limited within the terms of the legislation in force. You can request to exercise your right to data portability, i.e. your right to receive your Personal Data in a structured, frequently used format and your right to send this data to another subcontractor. As indicated in section 3 above, your data is processed with your consent and you can withdraw your consent at any time by going to "Settings". You also have the right to give instructions on how your personal data should be used after your death. In order to exercise your rights, you will be asked to produce proof of your identity of any kind. You can submit your request by sending a letter or an e-mail to hello@deskare.io or on Deskare in the "Assistance" section. We will do our best to satisfy your requests, but please remember that this right is not unlimited and must be exercised according to the conditions of the legislation in force. Any request to exercise your rights must be reasonable. Where applicable, we will explain the reasons why we are unable to satisfy your request. For any other complaint, please contact the competent national data protection authority.

Updates to our privacy policy

It may be necessary to update this Privacy Policy, in particular to comply with current regulations, or if there is a change in the way we use your Personal Data. You will be informed in advance of any changes or updates by any appropriate means, including messages displayed on the Deskare application, or by email. These changes may require your confirmation in certain cases. In any event, continuing to use Deskare implies full acceptance of the changes made to this Privacy Policy.
